Article 1. Purpose and identities

The present general conditions of sale determine the rights and obligations of the store La Folie Savon and the purchaser within the framework of the sale of the goods proposed hereafter called “the product(s)” or “the article(s)”, by La Folie Savon on its catalog available at the Internet address :www.lafoliesavon.com

No other condition can be integrated to these.

La Folie Savon intends to identify itself to the buyer by:

It is previously specified that the present conditions govern the sales of its products by the store La Folie Savon to any person or entity making a purchase via the website www.lafoliesavon.com , hereinafter referred to as “the Customer”, “the User», «the buyer”, or “you”.

The customer declares to have the full legal capacity allowing him to commit himself under the present General Conditions of Sale (GCS).

The present general conditions of sale can be modified at any time and without notice by La Folie Savon, the applicable conditions being those in force at the date of the order by the Customer.  They must be reread before each purchase.

 

Article 2. Access and use of the website www.lafoliesavon.com

You can only have one account on www.lafoliesavon.com  Multiple registrations will be automatically deleted by the administrators. In the “my account” section, you can follow the history of your orders (in progress, recently delivered or placed), and modify them if necessary. Moreover, you can also manage and store your personal data, as well as your subscriptions to newsletters.

La Folie Savon reserves the right to warn you, to terminate your membership, or to modify the submitted content, or to delete it in case of violation of an article of the present General Conditions of Sales. Any claim for damages in these cases will not be admissible.

On the other hand, on the Site of www.lafoliesavon.com , the Customer can order on line one or more products according to the present General Conditions. The Internet user or customer is personally responsible for setting up the computer and telecommunications means to access the Commercial Site of the company Le Comptoir des Savonniers Paris: www.lafoliesavon.com . The Customer shall bear the cost of telecommunications when accessing the Internet and using the site.

 

Article 3. QUALITY CHARTER

All our products are carefully studied to meet the requirements of our customers. The raw materials are of high quality: vegetable oils, vegetable glycerin, butters or essential oils, plant extracts or perfumes, …

However, the photos do not guarantee the real color of the products and are therefore not contractual. Moreover, due to the random nature of the cut to size of each product, only the weight is guaranteed (to within 2%) and not the size or thickness of each soap.

 

Article 4. THE PRODUCTS

In accordance with the provisions of Article L. 111-1 of the French Consumer Code, the customer may, prior to his order, take note, on the La Folie Savon website, of the essential characteristics of the product(s) he wishes to order. (Subject to available stocks).

The promotional offers are valid only on order via the Internet site www.lafoliesavon.com while stocks last. All the offers of products proposed are addressed to the Metropolitan France, the DOM TOM, Europe and the international.

In case of unavailability of the product after placing the order, the buyer will be informed by email or by a La Folie Savon advisor, of the delivery of a partial order or of the possibility of cancelling the order. The buyer will then be reimbursed for all or part of his or her order within a maximum of 30 days after placing the order. 

 

Article 5. THE PRICES

The prices of the products on the website www.lafoliesavon.com  are mentioned in euros (€), all taxes included (TTC), but excluding participation in the expenses of preparation and delivery. They are likely to vary during the year, it being understood that the ordered products are invoiced at the prices in force at the time of the taking into account of the order by La Folie Savon.

If one or more taxes or contributions, notably environmental or of any other nature, were to be created or modified, both upwards and downwards, this change could be passed on to the selling prices of the articles. Faced with significant increases in the cost of energy, transportation, packaging and raw materials, La Folie Savon reserves the right to modify the prices at any time. 

 

Article 6. DUTIES AND TAXES, CUSTOMS

TVA or Value Added Tax (VAT)

The French VAT rate indicated on the order form is the one in force and applicable on the day of the order.

The regulation is fixed by the European Union (CEE). For the shipment of products to a country of the European Union, the invoicing will be done including French VAT. For a possible shipment of products outside the European Union, the billing will be done without taxes and duties.

Any inaccurate information provided by the CUSTOMER in order to evade VAT may result in civil fines and criminal prosecution.

 

Customs

If the delivery takes place outside the territory of the European Union, the customs taxes and formalities relating thereto remain the exclusive responsibility of the purchaser. These rights do not fall under the jurisdiction of La Folie Savon. The customer must inform himself with the local authorities of the possible limitations of importation and/or use of the products which he plans to order. 

 

Article 7. ACCEPTANCE OF TERMS

Any order supposes the adhesion without restriction nor reserve to the present General Conditions of Sale. By validating his order, the customer recognizes to have taken knowledge of the General Conditions of Sale stated by La Folie Savon and expressly declares to accept them without reserve by notching the box envisaged for this purpose.

The present general conditions of sale govern the contractual relations between La Folie Savon and its customer, the two parts accepting them without reserve. These general terms and conditions will prevail over all other conditions appearing in any other document, except prior, express and written exemption. 

 

Article 8. ORDER CONFIRMATION, PROOF AND PROCESSING

Order Confirmation

By validating his order, the buyer is then considered to have accepted with full knowledge of the facts and without reservation the present general conditions of sale, the prices, the weights (plus or minus 2%), the quantities of the products offered for sale and ordered.

The customer must verify all the information entered during his order such as: products and quantities ordered, delivery address, billing address, contact information.

The sale is considered firm and definitive only after La Folie Savon has sent the buyer, by e-mail, on the one hand, the confirmation of the order summarizing the details of the order, its price (before tax, shipping costs and total amount including tax), the method of payment, the information relative to the follow-up of the order and the terms of delivery (address) and, on the other hand, the collection of the full price.

La Folie Savon recommends to the buyer to keep this information on a paper or computer document.

La Folie Savon reserves the right to cancel or to refuse any order of a customer with whom there would be a litigation, in particular, relating to the payment of a former order, or for lack of available stock.

Proof of the order

These order confirmations will be archived at the headquarters of La Folie Savon and will be considered as proof of the nature of the agreement and its date.

The computerized registers will be considered as proof of the communications, orders and payments made between the parties. The archiving of the purchase orders and invoices will be carried out by La Folie Savon on any support of its choice which could be produced as proof.

The buyer accepts that La Folie Savon ‘s order registration systems are proof of the nature of the agreement and its date.

Processing of the order

Orders are processed in the order in which they are actually received. La Folie Savon undertakes to process all orders, from Tuesday to Saturday, within the limits of available stocks.

La Folie Savon confirms to the customer the order and its total amount. This confirmation is carried out by electronic mail at the address communicated by the customer. It is expressly stipulated that the sales contract is formed only after the confirmation of the order and its payment by La Folie Savon. The data recorded by La Folie Savon constitute the proof of all the transactions made by La Folie Savon and its customers through the website www.lafoliesavon.com.

 

Article 8. RIGHT OF RETRACTION

In accordance with the French law of January 6, 1988, and with the directive n° 97.7 of May 20, 1997 codified in the articles L. 121-20 and following of the Code of the Consumption, the customer has a time of retractation of 14 working days as from the reception of the goods to turn over any product to La Folie Savon for exchange or refunding without penalty, by mail or at 32 rue Saint André des Arts, 75006 Paris, France.

In case of exercise of the right of retraction within the above-mentioned period, only the price of the purchased product(s) and the shipping costs will be reimbursed; the return costs will remain the responsibility of the customer.

The returns are to be made in their original condition and complete (packaging, accessories, instructions …) allowing their remarketing in new condition, and accompanied by a copy of the purchase invoice for optimal management.

 

Article 9. METHOD AND SECURITY OF PAYMENT

The payment must be made at the time of the order by the buyer. At no time, the paid sums could be regarded as deposits or installments. All orders are payable in Euros (€).

To pay his order, the buyer has the following payment method: Credit Card. Payment by credit card (Carte Bleue, Visa and Master Card) is made online when the order is placed and is entirely secure, ensured by the Société Générale bank.

In order to ensure the security of the payment by credit card, the buyer is obliged to transmit the visual cryptogram (CVV) of his credit card.

The entire transaction is directed in encrypted mode to a bank validation server in Secure 3D mode of the Société Générale by its online payment module Sogecommerce.

The buyer guarantees that he/she is fully authorized to use the payment card he/she is using and that the latter gives access to sufficient funds to cover all costs necessary for the payment of the order.

La Folie Savon reserves the right to suspend or cancel any order and/or delivery, whatever its nature and level of execution, in case of non-payment of any sum that would be due by the buyer or in case of payment incident.

Penalties of an amount equal to the conventional interest rate increased by 3 points are automatically applicable to the unpaid amounts as of notification of the rejection of banking payment. The delivery of any new order may be suspended in the event of late payment of a previous order, notwithstanding the provisions hereof.

In case of non-performance of all or part of the contract by the customer (payment of the price), all sums paid by the customer for the purchase of his goods, will be kept by La Folie Savon as a penalty clause.

 

Article 10. DELIVERY

If the procedures outlined below are not respected, no claim from the buyer will be accepted.

The purchaser is held to indicate in a precise way to La Folie Savon the information necessary to each delivery. In case of erroneous, incomplete address, of name not appearing clearly outside or on the mailbox, of day of closing not specified, of space not yet opened, etc… The costs of a new delivery will be at the exclusive charge of the buyer. In the case of a request for reimbursement of the order, La Folie Savon will only be able to reimburse the costs of the first delivery.

By default, invoices are sent to the main address indicated by the Customer during registration.

Deliveries are deemed to have been made as soon as the product is handed over to the buyer by La Poste Office, or ParisVélopostale or by hand (depending on the choice made), according to the control system used by the latter. A package received is a package accepted as this.

Sending orders and delivery times

Your orders are processed as soon as possible from Tuesday to Friday included.

When the order is finalized (1 to 2 days), it is given to its partners, La Poste, ParisVélopostale or delivered by hand.

La Folie Savon is not responsible for the delivery times indicated by its transport partners, La Poste or ParisVélopostale. The indicated delays are those usually noted. These indications are given as an indication and are not contractual.

ParisVélopostale: For any order in Paris Intramuros made before 1 pm, it is necessary to count a minimum of 2h30 from 2 pm, the same day. The price is 8€ TTC per trip during the day or the next day.

 The Post Office in France: It takes 48h to 72h to be delivered or receive a notice in the mailbox. As from the deposit of the notice of passage in the mailbox of the address indicated by the customer, this one has approximately 10 days to go to withdraw it at the Post office. If the Buyer does not have the notice of passage, it can nevertheless withdraw its parcel with an identity paper and the N° of follow-up near its post office. If this delay were exceeded, the parcel would be returned to La Folie Savon, 32 rue Saint André des Arts 75006 Paris France. The customer service will then contact the customer for a possible forwarding whose expenses will be the exclusive responsibility of the customer.

The Post Office, except Metropolitan France or DOM TOM, Europe and the international, the sending is envisaged normal in Colissimo, the times varying according to the destination. These deadlines are for working days, excluding postal delivery problems and depending on product availability.

Delivery dispute / Lost parcel via LA POSTE or PARISVELOPOSTALE

If the parcel appears as delivered in the follow-up of the Post Office or ParisVélopostale but that the customer did not receive it, it must then contact La Folie Savon which will open an investigation with the conveyor to ask for a proof of delivery. The Post Office will then have a maximum of 6 weeks to send the proof of delivery to La Folie Savon.

If the post office or ParisVélopostale is not able to transmit a proof of delivery, the parcel will be declared lost. La Folie Savon will then notify the customer and will proceed immediately to the formalities of refunding of the order corresponding to the lost parcel (products and postal charges).

On the other hand, if the Post Office or ParisVélopostale sends a document validating the delivery, La Folie Savon will not be able to open a litigation file and thus not proceed to the refunding of the order.

The products being delivered by the Post Office or ParisVélopostale, the purchaser will have to apply the procedure to indicate the damage due, all complaints and reserves, and to obtain, if necessary, any form envisaged for this purpose near any office of the French Post office or ParisVélopostale.

 

Delivery dispute / Damaged parcel via the carrier

Any anomaly that occurred during transport and in any case detected upon delivery (damage, missing product compared to the delivery note, damaged package, damaged products …) must be indicated on the transport note in the form of “handwritten reserves”, accompanied by the signature of the customer.

Within the framework of a dispute opening for mislaid parcel, the photocopy of the ID card of the customer is necessary as well as a declaration on the honor of non-reception of the parcel. In case of non-respect of this procedure no refund can be considered. 

 

Article 11. LEGAL GUARANTEE

The customer benefits from the legal guarantee which does not prevent the guarantee of hidden defects on the sold products. Provided that the buyer proves the hidden defect, the seller must repair all the consequences (Art. 1641 and following of the Civil Code); if the buyer goes to court, he must do so within a “short period of time” from the discovery of the hidden defect (Art. 1648 of the Civil Code). 

 

Article 12. PRODUCT RETURN – DELIVERY ERROR – NON-CONFORMITY

The customer has a right of return of 14 days after receipt of the package. During this period, the return of the parcel is totally guaranteed: no justification will be requested.

Any return must, thus, be sent to the Customer service of La Folie Savon by postal way to 32 rue Saint André des Arts 75006 Paris and accompanied by the photocopy of the invoice and by indicating the wish of the customer (exchange-refund or credit note).

If the error comes from La Folie Savon (deteriorated product, bad product sent, qualitative anomaly,) the expenses of return will be refunded on written request, invoice of the Post office in support.

To return an article, it is advisable to respect certain points:

The item must not have been removed from its original packaging and must not have been used. The article(s) to be exchanged must be returned with a copy of the invoice indicating the reason for the return to La Folie Savon. If the above procedure is not respected and the indicated deadlines are not met, the customer will not be able to formulate any complaint for lack of conformity or apparent defect of the delivered products. The expenses and risks related to the return of the product are the responsibility of the buyer.

La Folie Savon does not accept packages sent by postage due.

The initial delivery charges are not refunded.

If the customer requests an exchange, he/she will receive it at no additional cost. If the exchange is made for an article of a higher amount, the additional payment will have to be made before sending the said article.

On the other hand, if the return is not accepted by the La Folie Savon Customer Service, the buyer will not be able to exercise his right of return and will have to keep his product without the possibility of being reimbursed or receiving a credit note. If the return is refused by the La Folie Savon Customer Service and that the purchaser sends back the product, this one cannot be refunded. If the buyer wishes to enjoy again his unduly returned product, he will have to make the request by email or by mail to La Folie Savon which will then send the product as soon as possible. The expenses of forwarding will be chargeable to the purchaser and payable in advance by bank card.

In the case of a refund, your account will be automatically re-credited within 30 days maximum after reception of the packages. 

 

Article 13. RESPONSABILITIES

La Folie Savon undertakes to provide the content of its professional site diligently, within the framework of an obligation of means.

La Folie Savon cannot be held responsible for the non-execution of the contract in case of stock shortage or unavailability of the product due to a case of force majeure, disruption or total or partial strike, notably of the postal services, means of transport, communications and/or suppliers.

La Folie Savon shall not be held responsible for any indirect damage that may occur as a result of the purchase of products (possible unavailability of certain site content, etc.).

Moreover, the responsibility of La Folie Savon could not be committed in the event of non-observance of the legislation of the country where the product is delivered (for example in the event of prohibition of a product…). It is up to the client to verify with the local authorities the possibilities of importing or using the products or services that the client plans to order.

La Folie Savon cannot be held responsible for damages of any kind, whether material or immaterial or physical, which could result from a malfunction or misuse of the marketed products.

La Folie Savon cannot be held responsible for any risk inherent to the use of the Internet, such as a suspension of the service, an intrusion, the presence of a computer virus or loss of data or files. It is up to the buyer to make all necessary backups.

It is the same for the possible modifications of the products resulting from the manufacturers.

In addition, it should be noted that the www.lafoliesavon.com website contains information from third parties and links to other websites. www.lafoliesavon.com can in no way be held responsible for damages resulting from the use of, access to, or inability to use this third-party information, nor for the content of these other websites over which La Folie Savon has no control.

In case of professional or non-professional purchases, La Folie Savon shall not be held responsible for any indirect damage, operating loss, loss of profit, loss of opportunity, damage or expenses that may arise from the purchase of products.

Without recognizing any responsibility, the responsibility of La Folie Savon will be, in any case, limited to the amount of the order and could not be called into question for simple errors or omissions which could have remained in spite of all the precautions taken in the presentation of the products. In case of difficulties in the application of this contract, the buyer has the possibility, before any legal action, to seek an amicable solution in particular with the assistance of: a professional association of the branch, an association of consumers or any other council of its choice. It is reminded that the search for an amicable solution does not interrupt the “short period” of the legal guarantee.

It is reminded that as a general rule and subject to the appreciation of the Courts, the respect of the provisions of the present contract relating to the contractual guarantee supposes that the purchaser honors his financial commitments towards the seller.

In the event of a dispute, the customer shall first contact the company to obtain an amicable solution. Failing that, the case will be brought before the competent courts.

 

Article 14. MAJOR FORCE

Neither party may be sued for failure to perform its contractual obligations to the extent that their performance is delayed, hindered or prevented by an act of God or force majeure. An act of God or force majeure shall be considered to be any irresistible fact or circumstance, external to the parties, unforeseeable, independent of the will of the parties and which cannot be prevented by the latter, despite all reasonably possible efforts.

The party affected by such circumstances shall notify the other within ten working days of the date on which it becomes aware of them. The two parties will then meet, within one month, unless impossible due to force majeure, to examine the impact of the event and agree on the conditions under which the performance of the contract will be continued. If the case of force majeure lasts longer than three months, these general conditions may be terminated by the injured party.

Expressly, are considered as force majeure or fortuitous events, in addition to those usually retained by the jurisprudence of the French courts and tribunals, the blocking of means of transport or supplies, epidemics, earthquakes, fires, storms, floods, lightning, wars; the stoppage of telecommunication networks or difficulties specific to telecommunication networks external to the customers.

 

Article 15. INTELLECTUAL PROPERTY RIGHTS

All the elements, marks, drawings, models, logos, graphics, information etc… diffused on the site are the property of La Folie Savon, thus are reserved exclusively to him with the title of royalty and intellectual property. Any copy, modification, extraction or distribution of this information, total or partial, by some process that it is, for a use other than strictly personal, is strictly prohibited.

Any reproduction, representation, dissemination or use of the contents of the website and catalog form the properties of the company Le Comptoir des Savonniers Paris. They are subject to the laws governing copyrights, an offense punishable by criminal penalties. Any reproduction, republication or redistribution by any means whatsoever is totally prohibited by law without written permission from the person concerned. 

 

Article 16. DATA PROTECTION AND PRIVACY – COMMERCIAL AND INFORMATIVE OFFERS – SOCIAL NETWORKS – COOKIES

The Privacy Policy applies to the www.lafoliesavon.com  website. It sets out the policy that will be applied in relation to the processing of personal data in accordance with the General Data Protection Regulation (“GDPR”).

 

  1. PROTECTION OF PERSONAL DATA

The Customer is informed and accepts that his or her personal data may be collected on the Site www.lafoliesavon.com and in the store, and used by La Folie Savon, which acts as a data controller within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter the “General Data Protection Regulation” or “GDPR”).

La Folie Savon commits itself to protect, to ensure the security and the confidentiality of the personal data of its Customers in accordance with the RGPD, in particular by taking all useful precautions to prevent that these data are distorted, damaged or that unauthorized third parties have access to them.

The personal data that we collect includes:

– Your contact details (title, surname, first name, email address, telephone number, full postal address, etc),

– Your personal information (date of birth, gender, etc),

– Your delivery information (first and last name, street, postal code, city, country, delivery comments, etc.)

– Your personal preferences, including your marketing preferences (newsletter subscriptions, etc.) and cookie preferences (technical information: technical logs, IP address, etc.)

– Information about the products you have consulted,

– Bank payment data,

– The history of your orders,

– The history of your e-mails exchanged with the customer service.

The creation of an account on the Site requires the creation of a password. This password is encrypted and is known only to you. It is not possible for us to access it. If you forget your password, a link allowing you to set a new password will be sent to your contact e-mail.

In particular, the personal data of Customers may be transmitted to service providers and contractual partners who, as subcontractors within the meaning of the RGPD, intervene and contribute directly to the management of Orders and for whom it is absolutely necessary to have access to the personal data provided by the Customer when creating and using his/her Account (identity, postal address, telephone number, e-mail address). The subcontractors can only act upon instructions from La Folie Savon.

The personal data of Customers is collected for the following purposes:

– The management of the Account, registrations, connections to the site www.lafoliesavon.com , orders, delivery, complaints, and relations with the Customers;

– The information of the Customers relating to the offers and commercial information (promotions, prospecting, development of customer loyalty, marketing studies,…) in connection with the brand;

– The reinforcement and improvement of the navigation and communication of the Website and the brand by sending, in particular, newsletters and special offers according to the preferences of the Customer noted on the Website;

– To improve and personalize the services offered to Customers;

– Statistical purposes

– Compliance with legal and regulatory obligations.

The Customer’s personal data is kept only for the time strictly necessary to achieve the above-mentioned purposes.

At the end of this retention period, your data will be permanently deleted or made irreversibly anonymous.

*Data from your customer account

Data retention 5 years from the end of the relationship with the site. The period starts from either the last order, or the last connection to your customer account, or the last call to the customer service, or the sending of an email to the customer service, or a click on a hypertext link of an email sent by La Folie Savon, or the putting of products in the basket without concretizing the purchase. At the end of these 5 years, an email asking if the customer wishes to continue to receive commercial prospecting will be sent. In case of no response or negative response, the customer’s data will be permanently deleted.

*Purchase data

Billing data will be kept until the end of the corresponding accounting period and the legal retention period (10 years).

*Payment data

Retention of your payment details until certification of payment and completion of the relevant administrative and accounting formalities concerning your right of withdrawal and the conditions applied to contest the payment.

*Subscription to advertising communications

Retention of your data for this purpose until the end of the service or until you cancel your subscription to the service which can be done at any time (by clicking on the “unsubscribe” link at the end of our newsletters).

In accordance with the RGPD, the Customer has a right of access, rectification and opposition to personal data concerning him (hereinafter the “Data Protection Rights”).

To exercise one or more of the Data Protection Rights, the Customer must send a request by email (contact@lafoliesavon.com ) or by mail to the Customer Service Department of La Folie Savon, by filling out the contact form located on the site or by writing to the following address La Folie Savon 32 rue Saint André des Arts 75006 Paris France, and indicating his name, first name, e-mail address and customer references.
